APP TERMS OF USE

Agreement and scope

These Terms govern your installation and use of applications provided by The Fox's Cache, including applications listed on our website or in the Wix App Market. By installing, subscribing to or using an app, you confirm that you are authorised to act for the relevant site or organisation and agree to these Terms. If you do not agree, do not install or use the app.

App functions and product information

Each app's product page and App Market listing describe its intended functions, requirements and available features. Those descriptions form part of these Terms. Our apps are operational tools and do not replace your judgement, source records or legal, tax, payroll, employment, regulatory or professional obligations.

Licence and acceptable use

We grant the installing site owner a limited, revocable, non-exclusive and non-transferable licence to use the app for lawful internal business purposes while the applicable subscription or access right remains active. You must not misuse an app, interfere with its operation, circumvent access or payment controls, reverse engineer it except where law permits, introduce malicious code, use it unlawfully, or infringe another person's rights.

Authority and user responsibilities

You are responsible for your Wix site and account, your configuration choices, the accuracy and lawfulness of information supplied to an app, maintaining appropriate records and backups, and ensuring that authorised users comply with these Terms. You must review outputs before relying on or distributing them.

Subscriptions, trials and cancellation

Paid plans, trials, renewals, taxes and refunds are administered through Wix and are subject to the price, currency and billing interval displayed when you subscribe. You may cancel through Wix. Unless required by law or expressly stated otherwise, charges already incurred are not refundable, and access continues only for the period Wix confirms.

Data and privacy

Each app accesses and processes only the Wix data and permissions reasonably needed to provide its stated functions. Our handling of personal information is described in The Fox's Cache Privacy Policy. You remain responsible for your notices to customers, staff and other individuals and for ensuring that your collection and use of information through the app is lawful.

Availability, maintenance and changes

We aim to keep our apps available, secure and accurate, but uninterrupted or error-free operation is not guaranteed. Wix services, third-party dependencies, internet availability and platform changes may affect performance. We may maintain, improve, modify, suspend or discontinue features where reasonably necessary, with notice where practicable.

Intellectual property

The Fox's Cache and its licensors retain all intellectual property rights in the apps, branding, interfaces, documentation and related materials. These Terms grant only the limited right to use an app described above and do not transfer ownership.

Consumer rights and liability

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law. To the maximum extent permitted by law, our apps are supplied without additional warranties, and liability for indirect, consequential or business losses is excluded. Any liability that may lawfully be limited is limited, at our option, to resupplying the affected service or the amount paid for the affected subscription period.

Suspension and termination

We may suspend or terminate access for material breach, unlawful or abusive use, security risk or non-payment. On termination, your right to use the app ends. Provisions concerning intellectual property, liability, governing law and matters intended by their nature to survive will continue.

Changes to these Terms

We may update these Terms to reflect changes to our apps, Wix requirements or applicable law. The current version will be published on this page with its effective date. Continued use after an update takes effect constitutes acceptance of the revised Terms where permitted by law.
